Live Present & Sober Membership TERMS

This Membership Agreement (“Agreement”) is entered into between Present & Sober (“Us” or “We”) and you, the participant (“You”).


By making payment, making an account or checking the box here, You agree to the following terms and become a member of the Program.


Definitions


Program: Membership services offered by Us, including teaching and coaching services as detailed on the offer page.

Offer Page: The webpage detailing the program's features, duration, and pricing.

You: The individual participating in the Program.


Consumer Protection Laws


This Agreement complies with applicable consumer protection laws in the UK, including provisions for refunds and cancellations.


Nature of the Program

  • Services are intended for personal use

  • Commitment and responsibility for participation rest solely with You. Your success is dependent on your engagement and is not guaranteed.


Confidentiality and Data Protection

  • You agree that our methods, processes and strategies taught in this program are our sole and exclusive property. You agree not to duplicate, disseminate, distribute or otherwise disclose any materials provided to You in the course of this Program to third parties.

  • You agree to maintain the confidentiality of the other program participants and their shared stories and experiences in the coaching and training sessions. This confidentiality includes keeping confidential any information that might serve to identify them to anyone who is not a registered participant of the Program. 

  • Whilst we make reasonable efforts to protect your confidentiality, We cannot and do not guarantee confidentiality for the participants of the Program.

  • We adhere to GDPR regulations in handling personal data. Details of data use, storage, and protection are provided separately. Breaches will be handled according to legal requirements.

Media Release

By participating in this program, you consent to the recording of your image, voice, and any contributions during Zoom calls and sessions. You agree that Present & Sober has the right to use these recordings for educational, promotional, or any other purposes in future programs without any compensation to you. Your participation serves as your voluntary agreement to this media release.

User Conduct and Obligations

  • You agree to conduct yourself respectfully and professionally during all interactions within the Program.

  • Any form of harassment, discrimination, or inappropriate behaviour is strictly prohibited.


Termination


You agree and accept that We may terminate your place on the program by providing You with written notice if we determine at our discretion that You are conducting yourself in a manner that is disparaging or disruptive to Us, the group or to another participant of the group, that infringes upon our intellectual property, or other rights, or that violates confidentiality provisions as outlined above.


Refund Policy


No refunds are given for monthly subscription payments and You will keep access until the end of your monthly billing cycle. Refunds are only given for yearly payments if we decide to terminate the Program before your subscription year is complete. If You leave of your own accord, You will not be given a refund.


Cooling Off Period


You have 14 days from the day after your membership is confirmed to cancel and receive a full refund. To cancel, please send us an email to hello@presentandsober.com. Refunds will be processed using your original payment method within 30 days of your cancellation request.

Advice Not Given


You agree and accept that this program is not intended and does not provide You with any medical, psychological or health advice. You acknowledge that this program is not a substitute for professional medical advice, diagnosis or treatment. You further acknowledge that You will seek the advice of a medical professional with any questions You may have regarding any medical condition or issue. You are responsible for any decisions You make relating to your health and wellness and all other matters during the course of and after this Program.


Liability Waiver

We do not guarantee specific outcomes from participation. You agree that We are not liable for any results relating to health, wellness, or other matters during or after the Program.

GDPR Compliance


Personal data is used to deliver services and communicate with You. Users have rights regarding their data, including access and rectification requests.


Intellectual Property

Our intellectual property includes all content, materials, and strategies provided. Violations will result in appropriate legal action.

Dispute Resolution

Disputes will be resolved through mediation or arbitration before any legal proceedings. Details are available in our dispute resolution policy.

Legal Jurisdiction

This Agreement is governed by the laws of England and Wales. Legal proceedings will take place in this jurisdiction.

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our control, such as natural disasters, war, or other unforeseen events.

Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in effect.

Entire Agreement

This Agreement constitutes the entire understanding between You and Us regarding the 

Program and supersedes all prior agreements or understandings.

Updates to Terms

We will notify members of updates to these terms. Continued participation after notification constitutes acceptance of changes. Members have the right to reject changes by terminating their participation.

By making payment, creating an account, or checking the box, You confirm that You have read, understood, and agreed to these terms and conditions.
